The Claim of Non-Compliance with Fundamental Precept 442 (ADPF 442) is a proposal that aims to decriminalize voluntary abortion up to the third month of pregnancy. ADPF 442 puts forward the claim that the criminalization of abortion up to the 12th week of pregnancy violates basic principles and guarantees of the constitution to women.
This is not the first bill of its kind on the subject. In 2012, the Supreme Court plenary decided that pregnancy can be interrupted in case of fetal anencephaly. The decision was the product of another bill of the same type, ADPF 54. Until then, the only two exceptions to legal abortion in Brazil were pregnancy resulting from rape and risk of death for the pregnant woman. In her statement on the bill in September, Rosa Weber proposed a new approach based on the concept of Reproductive Social Justice.
The report 'We Have to Say "Enough"': the Multiplatform Campaign in 2023 against ADPF 442 and the Right to Abortion in Brazil aims to collect and analyze publications about ADPF 442 and the debate on the right to abortion on different platforms in the ecosystem of Brazilian digital media. It also intends to map the production and circulation of narratives on the ADPF and the right to abortion in order to identify which are the prominent points in the movement to decriminalize abortion in the Judiciary. Furthermore, this report aims to identify the main players and cases associated with the discussion of the right to abortion.
